Contract law in relation to notice period.

Good day,

I joined the company on 01.04.1995.
There is a clause in the employment contract stating that the extended notice periods due to longer company tenure also apply to the employee.

I resigned from the company on 31.03.1995 and was not employed there for a week, during which time I worked at another company. This can be verified.

After that week, I returned to the old company, but a new written employment contract was never signed.

I am now looking for a new job and wondering if I can rely on the statutory notice period under the German Civil Code (BGB) since a new contract was not signed, as I do not want the extended notice periods to apply to me.

You have been with the company since 1995, which means for 16 years.

According to § 622 paragraph 2 No. 6 BGB, the employer would then have a notice period of 6 months, which also applies to you as an employee, if this is appropriately regulated in the employment contract.

If you find these 6 months too long, you should discuss a termination agreement with your employer.
