Parental leave, German employer
June 3, 2012 | 30,00 EUR | answered by Bernhard Müller
Situation: I am currently on parental leave and have agreed with my employer to resume my activities on 1 September.
Question: If I were to become pregnant again in July or August, does my employer have to take me back or can they require me to extend my parental leave? Is it legally possible for the employer to offer a termination agreement if I inform them on 1 September that I am pregnant again?
Dear questioner,
In principle, the employer must take you back after the end of parental leave. The only exception is tasks that a pregnant woman is not allowed to perform, for example working with X-ray machines.
Once the new child is born, you can take parental leave again.
Your employer can always offer a termination agreement. However, you are not obliged to accept such an offer. Instead, you can insist on being employed again in your old position until maternity leave for the new pregnancy begins.
