Ask a lawyer on the topic of Travel law

What steps should I take if my booked excursion is cancelled?

Dear travel lawyer,

I recently booked a trip and am looking forward to taking various excursions during my stay. Unfortunately, I have now learned that one of my booked excursions is cancelled. I am concerned that this could affect my vacation plans and wonder what steps I should take now.

The situation is as follows: I have reserved a trip to a specific landmark through the travel agency with which I booked the entire trip. This excursion was a highlight of my trip and I was looking forward to visiting the landmark. However, I have received news that the excursion is cancelled due to unforeseen circumstances.

My worry is that I do not know how to proceed. Should I contact the travel agency and request an alternative solution? Or do I perhaps have a right to a refund for the cancelled excursion? Is there a possibility to book a replacement excursion?

I would greatly appreciate your help and advice on this matter. What steps should I take to resolve my issue and make my vacation as enjoyable as possible?

Thank you in advance for your support.

Best regards,
Zofia Ehrig

Dear Mrs. Ehrig,

Thank you for your inquiry regarding the canceled excursion during your booked trip. It is understandable that you are concerned about how this incident will affect your holiday plans. I would like to provide you with some information and advice to help you resolve your issue.

First of all, it is important to know that as a consumer, you have certain rights when a booked excursion is canceled or cannot be carried out as planned. In your case, you booked the excursion through the travel agency, which means you have entered into a contract with the tour operator. According to § 651a of the Civil Code (BGB), the tour operator is obligated to provide the trip as agreed in the contract.

In the event of a change or cancellation of a part of the booked trip, such as in your case with the canceled excursion, you generally have the right to receive appropriate compensation or a price reduction. Therefore, you should first contact the travel agency and inform them about the canceled excursion. Inquire about possible alternatives, such as a replacement excursion or a refund of the costs.

If the travel agency is not willing to offer you a satisfactory solution, you may also consider taking legal action. For example, you could file a complaint with the tour operator or consult a lawyer specializing in travel law to assert your rights and potentially claim compensation.

However, it is important to note that the exact legal situation in your case may depend on various factors, such as the specific terms of the contract, the reasons for the cancellation of the excursion, and the provisions of travel law. Therefore, I strongly recommend that you seek timely advice from a lawyer specializing in travel law to receive individual consultation and support.

I hope this information helps you resolve your issue and make your holiday as enjoyable as possible. If you have any further questions or need additional assistance, I am happy to help.
