Ask a lawyer on the topic of Travel law

How can I proceed if my booked activity does not take place on site?

Dear legal team,

I recently booked a trip to Thailand, during which I also booked a specific activity. Unfortunately, upon arrival, I discovered that this activity will not take place, even though I had already paid in advance. I am very disappointed and frustrated by this situation, as I was looking forward to this activity and it was an important part of my trip.

I have already tried to speak with the local provider, but unfortunately, no solution could be found. I am concerned that I will not get my money back and that my trip will be affected as a result.

Could you please explain to me what steps I can take in such a situation to get my money back and potentially claim compensation? Are there specific legal regulations or consumer protection laws that can help me in this case? I want to ensure that my rights as a consumer are protected and that I am adequately compensated.

Thank you in advance for your support and advice.

Sincerely,
Selma Evers

Dear Mrs. Evers,

Thank you for your inquiry regarding the issues that arose during your trip to Thailand. I am sorry to hear that the activity you booked locally could not take place and that you had already paid for it in advance. In such a situation, it is understandable that you feel disappointed and frustrated.

If you find that a booked activity does not take place as agreed and the local provider does not offer a solution, there are certain steps you can take to get your money back and potentially claim damages. First and foremost, it is important to keep all relevant documents and receipts related to the booking and payment of the activity. These can serve as evidence in case of a legal dispute.

As a consumer, you have certain rights that protect you in such a situation. According to consumer protection laws, you have the right to performance of the contract, and in case of non-performance, you can withdraw from the contract and demand a refund. In your case, since you have already paid in advance and the activity did not take place, you have the right to demand a refund of the amount paid.

To get your money back, I recommend that you first request a refund in writing from the local provider. It is important to set a reasonable deadline for the refund and mention that you may take legal action if no solution is found.

If the provider does not offer a refund or refuses, you can contact a consumer protection agency or a travel law attorney to take further legal steps. An attorney can help you assert your rights and potentially claim damages.

I hope this information is helpful to you and wish you success in enforcing your rights. If you have any further questions or need assistance, please feel free to contact me.
