Moving from Switzerland to Germany while having an ongoing employment contract with a Swiss employer.
Good day!
After approximately 3.5 years of working in Switzerland as an employee, I am planning to return to Germany in mid-December. My contract with my Swiss employer is initially valid until December 31, 2019.
However, my planned date of deregistration is already December 15 or 16, 2019. This is due to discussions with the landlord, who is willing to release me from the contract early if the apartment can be handed over to a new tenant by mid-December.
I could continue my work remotely on my laptop from Germany during the remaining 14 days. Taking leave is not possible, except for a few days around Christmas.
To my knowledge, from a social security perspective, contributions must be paid to the employee's country of residence. Does this also apply in this case, or is there a transition period for such short cases?
I will not be able to ask my employer to deal with this in Germany for these 2 weeks. I also do not wish to do so, as I have always been and will remain self-employed in Germany (both as a freelancer and with a GmbH). If there are any social security issues, there is the option to terminate the employment relationship as of December 15, 2019 and handle the remaining 2 weeks as a service contract through my German GmbH.
Thank you for your support in this scenario!
