Lawyer does not send any documents.
July 26, 2010 | 25,00 EUR | answered by Steffan Schwerin
The current situation is that my lawyer apparently has no interest in forwarding any letters or information to me. Through indirect channels, I have learned that a settlement offer is on the table from the opposing party's lawyer. However, I know that they would be willing to waive 50% of the claim. I still do not know the exact wording of the offer. Okay, one must admit, it is not clear if the claim is justified, but that doesn't mean that my lawyer shouldn't say anything at all. After apparently the deadline for acceptance has passed, now the summons arrived at the house for the full amount and I am now angry. I assume that my lawyer should have informed me about this and I should have been able to decide whether to accept it or not. Who is now responsible for the damage incurred if my lawyer cannot rectify this?
Sincerely,
Joerg Lindner
Dear questioner,
I will answer the questions you have asked, taking into consideration the situation described and your input, as follows:
Your lawyer is obligated to keep you, as his client, informed about the status of the matter. He must pass on documents to you.
Especially if there is a settlement, your lawyer must inform you and discuss it with you.
If the lawyer cannot rectify a resulting damage, he is liable. He must then report this to his professional liability insurance. They will then compensate you for the damage.
I would like to point out that this platform cannot replace a detailed and personal legal consultation. The goal is solely to provide an initial rough assessment of your legal problem based on the information you have provided by a lawyer. The legal advice I provide is based solely on the information you have provided. Adding or omitting relevant information in your description of the situation can result in a completely different legal assessment.
I hope I have given you an initial overview and that my explanations have helped you. Please feel free to contact me through the follow-up option on this platform.
Furthermore, I am available for representation. I would credit the initial consultation fee in full.
Distance between lawyer and client is generally not a problem. With the help of modern communication tools such as email, mail, fax, and telephone, representation is also possible.
Best regards,
