Change of the employment contract to 9.75 hours per week.
November 12, 2010 | 25,00 EUR | answered by Steffan Schwerin
Dear Sir or Madam,
I have been working as a nursing assistant in a nursing home for 10 years. In July 2005, I reduced my hours to 21 per week. My parental leave ended on October 2, 2010, and I changed my hours to 9.75 per week. I will start work on December 9th as I still have a lot of remaining vacation days. I will be working one late shift per week and one weekend per month. The only change made to my contract was in paragraph 3.
I have worked alternating holidays, working on Christmas and having New Year's off, for example. Now I have been told that I have to work holidays again.
My question is:
Do I have the right to say "NO"?
Best regards,
Dear questioner,
I will answer the questions you have asked taking into consideration the circumstances described and your input as follows:
Whether you have to work on holidays depends on whether this has been contractually agreed upon or not.
If nothing has been agreed upon, you may have to work on holidays and cannot say "no."
If it was customary for you to work holidays on a rotating basis before your parental leave, this practice should be maintained after your parental leave.
I would like to point out that this platform cannot replace a detailed and personal legal consultation. The sole purpose is to provide an initial rough assessment of your legal issue based on the information you have provided, from a lawyer. The legal advice I provide is based solely on the information you have provided. Adding or omitting relevant information in your description of the situation may result in a completely different legal assessment.
I hope I have given you an initial overview and that my explanations have been helpful. Please feel free to contact me through the follow-up option on this platform.
Furthermore, I am also available for legal representation. I would credit the initial consultation fee to you in full.
A greater distance between lawyer and client is generally not a problem. With the help of modern communication tools such as email, mail, fax, and phone, legal representation is also possible.
Best regards,
