Can I make private calls during working hours?

Dear lawyer,

I am Dietrich Pasche and work for a company that has very strict rules regarding the use of private phone calls during working hours. However, lately I have been receiving more and more private calls that I had to take urgently, as they were related to family matters. Unfortunately, I couldn't always make these calls outside of my working hours, as they often came during regular working hours.

I am concerned that I may be violating company policies by making private calls during working hours. At the same time, I am unsure whether it is legally allowed to make private calls during working hours, especially when it concerns urgent family matters.

Could you please inform me whether it is legally allowed to make private calls during working hours? Are there possible solutions on how I can better handle private calls in the future without violating company policies? I would like to ensure that I comply with legal requirements and fulfill my family obligations. Thank you in advance for your help.

Sincerely,
Dietrich Pasche

Dear Mr. Pasche,

Thank you for your inquiry regarding the use of private phone calls during working hours. It is understandable that family matters are often urgent and you may be concerned about whether you are violating company policies or if it is legally allowed to make private calls during working hours.

In general, private phone calls during working hours at the workplace are usually not allowed, unless it is an emergency or a pressing family matter. In your case, if there are important family matters that arise during regular working hours and are urgent, it is justified to take private calls.

However, it is advisable to discuss the situation with your supervisor in advance and possibly find a solution. For example, you could suggest making brief private calls in such exceptional cases, but make up for the time during work hours or use your breaks for this purpose.

It is important to adhere to company rules and regulations, but there should also be understanding on the part of the employer for personal emergencies and family obligations. An open conversation can help to find a mutually acceptable solution.

If there are still problems or conflicts with the employer, feel free to contact me to clarify your rights in labor law and discuss further steps.

I hope this information was helpful to you and I am available for any further questions.

Best regards,
Bernhard Vollmann
