Duration of support for students
August 2, 2010 | 40,00 EUR | answered by Bernhard Müller
We are currently still supporting our son with 700 euros per month. He has completely cut off contact with us for several months. Through third parties, we heard about him passing the 1st State Examination in Law (certificates were issued in July) and that he will start a position in the legal clerkship on November 1, 2010. How long do we have to continue financially supporting him? He started his studies in the winter semester of 2003 and has been receiving support from us since then.
Dear inquirer,
the obligation to pay maintenance exists until the end of the 1st education. For us lawyers, this is the passing of the 2nd legal state examination. This occurs at the end of the 2-year traineeship.
However, the income of the son is taken into account for the maintenance obligation. During the traineeship, he receives trainee remuneration. You can ask your son to provide his salary statement.
If he does not comply with this request, you can withhold the maintenance payment until he has provided you with his salary statement.
The net salary he earns during the traineeship will then be deducted from the 700 euros starting from the month in which the salary is actually paid out (November or December).
Since the remuneration for trainees in most federal states is likely to exceed 700 euros, October or November will be the last month for which you must pay maintenance.
The maintenance obligation also ends if your son should refuse the trainee position offered to him without good reason.
Yours sincerely,
Bernhard Müller Attorney
