Maintenance after divorce
March 1, 2010 | 25,00 EUR | answered by Steffan Schwerin
I am living in separation and receiving spousal support. I worked in our joint business during my marriage, but was not registered and did not receive a salary (household expenses for 5 people were 1,000 DM per month for rent, clothing, food, and all expenses). I am now 54 years old, married for 34 years, sick, and can only work a maximum of 3 hours a day with long breaks. Currently, I have a mini job earning 228 euros. I moved out because of a younger person. My question is, will I continue to receive support after the divorce? What are the legal implications if I meet a new partner? Will the support be cut off or will I be entitled to a lower support amount? This is important.
Dear questioner,
I will answer the questions you have posed, taking into account the circumstances described and your contribution, as follows:
Between separation and divorce, there is spousal support from the husband to you.
During the divorce process, post-marital support will be agreed upon. Typically, this amounts to 3/7 of the difference between your income and the husband's.
If you have only a new boyfriend, this does not change the support. It is only when you remarry that post-marital support ceases.
I must point out that this platform cannot replace a detailed and personal legal consultation. The sole purpose is to provide an initial rough assessment of your legal issue based on the information you have provided, from a lawyer. The legal advice I provide is based solely on the information you have provided. Adding or omitting relevant information in your description may lead to a completely different legal assessment.
I hope I have given you an initial overview and that my explanations are helpful. Feel free to contact me through the follow-up option on this platform.
Furthermore, I am available for representation. The initial consultation fee would be fully credited towards your case.
Distance between lawyer and client is generally not an issue. With the help of modern communication tools such as email, mail, fax, and phone, representation can still be carried out.
Best regards,
