Can I get a refund if my booked excursion has been canceled on site?

Dear Sir or Madam,

My name is Wolfgang Albrecht and I recently booked a trip to Mallorca. As part of this trip, I also booked an excursion to a well-known tourist attraction, which was unfortunately cancelled at short notice on site. Now I am wondering if I can receive a refund for this excursion.

The situation is as follows: I had already booked and paid for the excursion in advance. When I arrived on site, I was informed that the excursion had to be cancelled due to technical problems. Naturally, I was disappointed as I was looking forward to this excursion and had already spent money on it.

My concern now is that I will not get my money back. I have already spoken to the tour operator, but have not received a clear answer yet. Therefore, I would like to know from you if it is legally possible to receive a refund for the cancelled excursion. Are there any legal regulations that could assist me in this case?

I would be very grateful if you could inform me of the options I have to get my money back. I hope that you can help me with this legal issue.

Thank you in advance.

Yours sincerely,
Wolfgang Albrecht

Dear Mr. Albrecht,

Thank you for your inquiry regarding the refund for the canceled excursion during your trip to Mallorca. I am sorry to hear that your holiday experience was marred by this unfortunate situation. I would like to assist you with your legal issue.

In terms of the refund for the canceled excursion, the legal regulations of travel law apply. According to § 651a BGB, as a traveler, you have the right to a reasonable reduction of the travel price if agreed services are not properly provided. This includes the organization of excursions offered as part of the booked trip.

In your case, the excursion was canceled due to technical problems, which constitutes a case of non-fulfillment of the contractually agreed service. In this case, the tour operator is obliged to refund you the amount paid for the canceled excursion. This arises from the tour operator's obligation under § 651f BGB.

I therefore recommend that you request a refund of the amount paid for the canceled excursion in writing from the tour operator. Set a reasonable deadline for the repayment and reserve the right to take legal action if the tour operator does not comply with your demand. It is important to collect and keep all relevant documents such as booking confirmations, proof of payment, and the notification of the excursion cancellation.

If the tour operator is still unwilling to refund you even after your written request, I recommend that you seek advice from a specialized lawyer in travel law. They can legally assess your claims and potentially take legal action to recover your money.

I hope that my explanations have been helpful in addressing your legal issue. If you have any further questions or need assistance, please do not hesitate to contact me.

Best regards,
