compensation for pain and suffering
January 18, 2010 | 20,00 EUR | answered by Steffan Schwerin
I had an accident 4 years and 3 months ago. It was 100% my fault. On 14.01.10 I received a letter (the lawsuit) from the court. The victim (his lawyer) is suing me and my insurance for damages. He received 1,500 euros in damages in January 2006, but is claiming 4,000 euros. The accident caused a tear in his lung. Reports from the doctors confirm that he has healed. The insurance is referring to the medical reports. I am supposed to respond in writing within 14 days. What should I do? Should I hire a lawyer? Isn't it a matter between the insurance and the victim? Sincerely, N.S.
Dear questioner,
I will answer the questions you have asked taking into account the circumstances described and your input as follows:
In this case, the victim must sue the party at fault and their insurance company together. However, only your insurance company will actually pay for the damages.
You should consider hiring a lawyer to defend you against the lawsuit. If you do not do so, a default judgment may be issued against you.
You can also represent yourself in court without a lawyer, but you must do so within the specified timeframe.
If you received the letter on January 14, 2010, you have until January 28 to respond.
You can also coordinate with your insurance company and devise a strategy for how to proceed. However, it is uncertain whether the insurance company will agree to this.
Please note that this platform cannot replace a detailed and personal legal consultation. The goal is to provide an initial rough assessment of your legal issue based on the information you have provided. The legal advice I have given is based solely on the information you have provided. Adding or omitting relevant information in your description could lead to a completely different legal assessment.
I hope I have been able to give you an initial overview and that my advice will be helpful. Please feel free to contact me through the follow-up option on this portal.
Furthermore, I am available for legal representation if needed. The initial consultation fee would be credited in full.
Distance between lawyer and client is not an issue. With the use of modern communication tools such as email, mail, fax, and phone, representation can still be carried out effectively.
Best regards,
