Running a red light

Hello,

I drove through a red light when it was already red and got flashed. According to today's letter, it was already red for over a second, which I can't really believe. Now, my mother as the vehicle owner has received the questionnaire. There were no pictures included, and no indication of how long the light had been red.
I also can't imagine that the pictures would be very revealing, as it is stated that I drive a Daimler, which is not true. I drive a VW Polo.

What is the best way for me or my mother to proceed so that I can avoid the one-month driving ban. I cannot afford to surrender my license for a month for personal and professional reasons.

I request information on this matter. Providing coverage for a possible objection would be a formality, as I work in the insurance industry where I have my legal expenses insurance.

Dear questioner,

The authority assumes that the owner of the vehicle was also the driver who committed the red light violation.

Your mother should therefore state that you were not driving the vehicle at the time in question. The authority would have to prove that she actually was driving, which will not be possible without a photo. Your mother does not have to disclose who actually drove the vehicle. If there are any discrepancies in the vehicle information, these should also be corrected.

An objection from your mother would only be appropriate if a fine is imposed on her despite stating that she was not driving.

Your legal expenses insurance should not be used here, as you are currently not involved in the proceedings.

If you have any questions, please ask.

Kind regards,

Andreas Scholz, Esq.
