Ask a lawyer on the topic of Tenancy law

My landlord does not want to extend the lease, even though I have done nothing wrong. Is this legal?

Dear lawyer specializing in tenancy law,

I am Marcus Gehrmann and I have a question regarding my rental agreement. I have been renting my apartment for three years and have always paid my rent on time. I have also not received any complaints from the neighbors and have always kept the apartment tidy. Now my landlord has informed me that he does not want to extend the rental agreement.

I am very concerned about this situation, as I feel very comfortable in my apartment and do not understand why my landlord suddenly does not want to continue working with me. I have already asked him for a reason, but he has not given me any specific reasons.

My question to you as an expert in tenancy law is: Is it legal for my landlord to refuse to extend the rental agreement, even though I have behaved correctly? Are there any ways I can challenge this decision and keep my apartment?

I would greatly appreciate your help and advice on this matter, as my living situation is very important to me.

Thank you in advance.

Sincerely,
Marcus Gehrmann

Dear Mr. Gehrmann,

Thank you for your inquiry regarding the termination of your lease by your landlord. It is understandable that you are concerned about the situation, especially if you feel comfortable in your apartment and have not received any specific reasons for the termination.

In Germany, a landlord has the right to terminate a lease if there is a legitimate interest. This could be, for example, the landlord's own need for the property or serious violations of the lease agreement by the tenant. However, in your case, you have stated that you have behaved correctly and there are no complaints.

In such cases, it is important to determine whether the landlord's termination is lawful. It should be noted that the landlord can terminate the lease without specific reasons, as long as they adhere to the legal notice periods. These periods are usually quite long, typically three to six months.

If the termination by your landlord is deemed invalid, you can challenge it and fight for the continuation of the lease. It is advisable to seek the advice of an experienced attorney specializing in tenancy law, who knows your rights and can assist you in this process.

It is important to gather all relevant documents and evidence that demonstrate your proper behavior and thus show that the termination of the lease is unfounded. An attorney can help you take all necessary legal steps and ensure that your interests are adequately represented.

I hope this information is helpful to you and supports you in your matter. If you have any further questions or would like a personal consultation, I am at your disposal.

Best regards,
