Dear lawyer,
I am reaching out to you with a question regarding social security law. My name is Eiko Rosenblatt and I work as a mechanic in a car workshop. Recently, I had a work accident in which I suffered a severe arm fracture. I am currently on sick leave and I am wondering what benefits I am entitled to under the statutory accident insurance.
I am worried because I am currently unable to work and as a result, I am experiencing loss of income. Additionally, I am concerned about the medical treatment and rehabilitation that I may need in order to fully recover.
So, my current situation is that I am unable to work due to the work accident and therefore experiencing loss of income. I have already contacted my health insurance, who advised me to also report the accident to the statutory accident insurance.
Therefore, I would like to ask you what benefits I am entitled to under the statutory accident insurance and how I can apply for them. Are there specific benefits for medical treatment and rehabilitation after a work accident? What steps do I need to take to receive the benefits I am entitled to?
Thank you in advance for your support and advice.
Kind regards,
Eiko Rosenblatt
Dear Mr. Rosenblatt,
Thank you for your inquiry regarding social security law in relation to your work accident. I understand that this situation is very stressful for you and would like to provide you with all the information you need.
Under statutory accident insurance, you are entitled to various benefits if you have suffered a work accident. These include medical treatment, medical rehabilitation, injury benefit, and disability pension.
Medical treatment includes all medical measures necessary for your recovery and restoration of your health. This includes doctor visits, hospital stays, medication, physiotherapy, and other medical services.
Medical rehabilitation is aimed at helping you restore or maintain your ability to work. Individual measures tailored to your specific situation will be determined. These may include inpatient or outpatient rehabilitation, vocational measures, or psychological support.
Injury benefit is paid to you during your inability to work and usually corresponds to a percentage of your average earnings. The disability pension is paid if you are permanently restricted in your ability to work due to the work accident.
To receive the benefits you are entitled to, you must fill out an accident report form with your employer and send it to the relevant employers' liability insurance association or accident insurance fund. They will review your case and determine the benefits you are entitled to.
Additionally, you should also contact your treating physician to ensure that all necessary measures for your recovery are being taken. Your doctor can also assist you in applying for benefits under statutory accident insurance.
I hope this information has been helpful to you. If you have any further questions or need assistance, please feel free to contact me.
Sincerely,
Fred Schönecker, Attorney at Law
