Owners' meeting
September 21, 2011 | 30,00 EUR | answered by Steffan Schwerin
Dear Sir or Madam,
Several years ago, I joined a civil law partnership. This partnership acquired a condominium for rental purposes. In the land register, all partners were registered as owners with the note "in civil law partnership".
I have already terminated my participation in the partnership as of 31st December 2008. Since the settlement has not yet taken place, I am still registered as a co-owner in the land register.
Question: Who should be invited to the owners' meeting by the property management company and who is eligible to vote during the owners' meeting?
a) the partnership
b) the partnership and myself
c) the owners registered in the land register
I assume that the property manager is not informed about my withdrawal from the civil law partnership.
Dear questioner,
I will answer the questions you have asked, taking into account the circumstances described and your input, as follows:
In principle, all owners registered in the land register must be invited.
Your departure from the BGB company must still be noted in the land register if you are no longer the owner.
The property management is not obligated to verify this.
Finally, I would like to point out that this platform cannot replace comprehensive and personal legal advice. The sole purpose is to provide an initial rough assessment of your described legal issue based on the information you have provided to a lawyer. The legal advice I provide is based solely on the information you have provided. Adding or omitting relevant information in your description of the circumstances may result in a completely different legal assessment.
I hope I have been able to give you an initial overview and that my explanations have been helpful. You are welcome to contact me through the follow-up option on this platform.
Furthermore, I am available for legal representation. The initial consultation fee you have paid would be fully credited.
A greater distance between lawyer and client is generally not a problem. With the help of modern communication tools such as email, post, fax, and telephone, legal representation is also possible.
Best regards,
Steffan Schwerin
