Ask a lawyer on the topic of Other questions to lawyers

mistaken identity

I am French, single, and have been living in Germany for 34 years. A woman from La Réunion believes that I have married her husband. She called me, wanting to speak to her husband and wouldn't let me explain. She called me a liar. I simply hung up, and with other calls from her, I didn't speak to her but hung up immediately. I received mail addressed to her husband at my address, which I returned to the sender, including 2 from the Amtsgericht München. She left a message on my answering machine saying she wants to get divorced. My question is: did I behave incorrectly by returning the mail?

Dear questioner,

I answer the questions you have asked taking into account the facts and your input as follows:

No, you have acted correctly.

If the man the caller is referring to does not live with you - which is understandable - then the mail has indeed been misdelivered.

While court mail is very important, if the man does not live with you, then the court mail cannot be delivered to you either.

Therefore, you were right to return this mail.

In conclusion, I must point out that this platform cannot replace a comprehensive and personal legal consultation. The sole aim is to provide an initial rough assessment of your legal problem based on the information you have provided by a lawyer. The legal advice I provide is based solely on the facts you have provided. Adding or omitting relevant information in the description of your case may result in a completely different legal assessment.

I hope I have given you an initial overview and that my explanations help you. Please feel free to contact me through the follow-up option on this platform.

Furthermore, I am also available for legal representation. I would credit the initial consultation fee in full.

A greater distance between lawyer and client is generally not a problem. With the help of modern communication tools such as email, mail, fax, and phone, legal representation is also possible.

Best regards,
