My question is:
My friend is unemployed and we are a household receiving benefits because I receive Hartz4. He received his salary for July in August. Can the Hartz4 office fully count his salary in the calculation for August for me?
Dear advice seeker,
I would like to answer your question based on the facts you have provided and taking into account your contribution as follows:
The question of when income in the context of ALG II ("Hartz4") is to be taken into account is legally regulated in the so-called Arbeitslosengeld II-Verordnung (AlgII-V).
According to § 2 paragraph 2 of this regulation, ongoing income is to be taken into account in the month in which it is received, that is, when it is received by the recipient of the benefit.
Therefore, your friend's July salary should be taken into account in August, as it was received in that month.
However, the legally prescribed allowances are to be deducted from the income.
I hope that my answer has given you an initial overview of the legal situation.
I would like to point out that this answer, based on the information you provided, is only an initial legal assessment of the situation. It cannot replace a comprehensive evaluation. By adding or omitting relevant information, the legal assessment could be completely different.
