Proof of the hours worked.
October 21, 2010 | 30,00 EUR | answered by Steffan Schwerin
Dear Sir or Madam,
In order to complete my vocational training, I require proof of the hours worked during the time I spent at my previous employer. However, they are refusing to provide this, so now it is going to mediation before the labor court. The other party keeps challenging the date for this mediation.
Now, the other party is demanding that I provide suitable evidence of whether and where I will be completing my training. However, I am not willing to do so (I am happy to provide this to the court, but not to the other party - I don't think it is any of their business where I am currently working). Additionally, I question why they want this information, other than to cause harm to me.
Just for clarification, I had a flat rate payment for my working hours.
Therefore, my questions are:
- Do I not have the right in principle to receive a summary of my hours worked, regardless of my training?
- How can I obtain the proof of hours worked so that the other party is obligated to provide it to me?
- Am I obligated to show where I am currently continuing my work?
Thank you very much.
Sincerely,
Dear questioner,
I will answer the questions you have asked taking into account the circumstances described and your commitment as follows:
You are right, the other party has no right to know where, how, and when you complete your training. You do not have to disclose this information to the other party.
However, you are entitled to receive proof of your hours from the other party.
If the other party refuses, create a summary yourself and have it confirmed by the other party or the court.
