Hello,
I have a problem.....I took out car insurance with OVAG on 05.01.10. The problem now is that while the insurance sent electronic confirmation to the relevant registration office, I have not received an insurance certificate from them. Unfortunately, I had a minor accident on 06.10.10 and now my insurance is refusing to pay the other party because they claim there is no insurance in place. I have already had the registration office confirm that my vehicle is definitely insured and they even provided me with the number of this electronic confirmation. What should I do now? The other party (leasing company) is demanding nearly 600 euros from me or they will take legal action against me. What is the best course of action for me now? In my opinion, it is not my fault if the insurance has made a mistake, because according to the vehicle registration, my car is insured, otherwise they would have immobilized it. Please help me. By sending the electronic insurance confirmation from the insurance company, you received provisional insurance coverage, so a contract has already been concluded. Basically, you had insurance coverage for the entire period, albeit only provisional.
The insurance commitment provided in the provisional coverage is valid until the policyholder receives the insurance policy. The policyholder can lose provisional coverage only if there are serious violations of their obligations arising from the insurance contract. These obligations of the policyholder can be found in the terms and conditions of the respective insurance company, e.g. in case of non-payment of premiums. If the motor vehicle liability insurance expires, the insurance company must report this to the registration office.
Therefore, you should inform the insurance company with the electronic confirmation number that there is at least provisional insurance coverage and request the insurance company to settle the claim. You should also request the insurance policy to be sent to you. Finally, I would like to point out that the insurance company is generally obligated to provide you with liability coverage (see § 5 PflVG), so the insurance company cannot simply reject your application without special reasons.
