Alimony after divorce for the ex-wife
February 28, 2011 | 30,00 EUR | answered by Steffan Schwerin
Dear Sir or Madam,
I am divorced and earn 930 euros net, my husband earns 2158 euros net (of which 309 euros for each of our 2 children are deducted as child support), so he has 1540 euros net left.
He lives with his girlfriend. She lives with him without contributing to the expenses.
Recently, I asked him to contribute to the costs of tutoring, but he refused.
My questions:
1. Does he have to contribute to the costs of tutoring?
2. Does he have to pay alimony for me after the divorce? If yes, how much?
Thank you and best regards.
Dear questioner,
I will answer the questions you have asked, taking into consideration the circumstances described and your input, as follows:
1. Does he have to contribute to the costs of tutoring?
Whether the father has to pay in addition to child support depends on whether tutoring can be classified as special needs.
Special needs can indeed be claimed for tutoring if the need for tutoring was unforeseen and does not last for an extended period.
2. Does he have to pay me alimony after the divorce? If so, how much?
If nothing was agreed upon in the context of the divorce, the man must also pay post-divorce alimony.
You should definitely demand this.
The amount depends on the incomes. After deducting child support payments, approximately 1500 euros can be attributed to the man and 900 euros to you.
As a result, the man would have to pay about 250 euros.
Finally, I must point out that this platform cannot replace comprehensive and personal legal advice. The sole purpose is to provide an initial rough assessment of your legal issue based on the information you have provided to a lawyer. The legal advice I provide is based solely on the information you have provided. Adding or omitting relevant information in your description of the situation may result in a completely different legal assessment.
I hope I have given you an initial overview and that my explanations help you. Feel free to contact me through the follow-up option on this platform.
Furthermore, I am available for representation. I would credit the initial consultation fee to you in full.
A greater distance between lawyer and client is generally not a problem. With the help of modern communication tools such as email, mail, fax, and telephone, representation is also possible.
Best regards
