Ask a lawyer on the topic of Divorce law

Excerpt from a shared house.

Dear lawyer,

I have been married to my husband for about 10 years (no children together) and we currently live together in his house, of which he is the sole owner.

Due to my husband's desire for divorce, which he verbally communicated to me a month ago, he has now given me a verbal deadline of 3 months to move out of his house. As far as I know, a verbal declaration of intention to separate is not sufficient to initiate the separation year.

Since I do not intend to comply with his divorce request at this time, I would like to ask you the following:

Is my husband entitled to evict me from his house within the next three months? Can he legally force me out of his house against my wishes before the divorce is finalized?

I appreciate your assistance in advance.

Dear questioner,

I will answer the questions you have asked taking into consideration the situation described and your input as follows:

Yes, you are already in the separation year. There is no need for a written explanation.

If it is his house, he can ask you to move out. You must comply and find a new apartment as soon as possible.

If you are unable to do so within 3 months, it is not a problem. However, you should still try.

Otherwise, the man can indeed demand that you move out if it is his house.

I apologize for not having a more positive answer for you.

I would like to point out that this platform cannot replace comprehensive and personal legal advice. The sole purpose is to provide an initial rough assessment of your legal issue based on the information you have provided to a lawyer. The legal advice I provide is based solely on the information you have provided. Adding or omitting relevant information in your description of the situation may result in a completely different legal assessment.

I hope I could give you an initial overview and that my explanations help you. Please feel free to contact me through the follow-up option on this platform.

Furthermore, I am also available for a formal mandate. I would credit the initial consultation fee in full.

A greater distance between lawyer and client is generally not a problem. With the help of modern communication tools such as email, mail, fax, and telephone, handling a mandate is also possible.

Best regards,
