Ask a lawyer on the topic of Contract law

What can I do if I am unhappy with a contract?

Dear lawyer,

My name is Georg Schreiber and I am contacting you with a question regarding contract law. Recently, I signed a contract that has left me very dissatisfied. It is a service contract with a craftsman who was supposed to carry out work in my house. Unfortunately, the agreed services were not performed as agreed and the quality of work is very poor. Additionally, the costs were significantly exceeded and there were delays.

I am concerned because I have already paid a large part of the agreed fee and the work is not yet completed. I feel financially disadvantaged and do not know how to proceed. What legal steps can I take to get out of this contract or at least receive appropriate compensation? Are there ways to claim the deficiencies in the services provided and request a refund of my money?

I am grateful for your help and support in this matter. It is important to me that my interests as a consumer are protected and that I do not end up bearing the costs of the inadequate services. I hope for clear and understandable advice from you to find a solution to this problem.

Best regards,
Georg Schreiber

Dear Mr. Schreiber,

Thank you for your inquiry regarding the service contract with the craftsman that has led to dissatisfaction and financial issues. It is understandable that you feel disadvantaged in such a situation and are looking for ways to assert your rights as a consumer.

First and foremost, it is important to emphasize that as a consumer, you are legally protected and entitled to proper services as per the contract that was agreed upon. Since the agreed services were not provided as agreed and the quality of work is lacking, you have the right to claim defects and demand appropriate compensation.

In your case, I recommend that you first contact the craftsman and clearly communicate the defects and financial disadvantages. Request a rectification of the services provided or appropriate compensation for cost overruns and delays. Set a reasonable deadline for the rectification of the defects.

If the craftsman does not respond to your demands or offer a satisfactory solution, you may consider taking legal action. You have the right to terminate the contract due to the improper services provided and potentially claim damages. In such a case, it is advisable to seek legal assistance to assess and enforce your claims.

Furthermore, you can also contact the consumer protection agency for support and advice on consumer issues. There, you will receive further information about your rights as a consumer and possible legal actions against the craftsman.

It is important that you stand up for your interests and do not accept the costs and inadequate services. I hope that my advice will help you in resolving this issue and I am available for further consultation.

Sincerely,
Mia Schulz, Attorney at Law
