Usufruct right tax question
April 21, 2021 | 35,00 EUR | answered by Steuerberater Knut Christiansen
Hello,
my mother and I have agreed on the right of usufruct. Now the roof renovation is due. Can I, as the owner in the land register, submit the entire bill and how much % would I get refunded?
Thank you

Good day and thank you for using ask-einen.com!
I would like to answer your question as follows:
The costs for roof renovation can be claimed within the scope of renting by the person who earns the income (as the usufructuary), if they also bear the costs and this is agreed upon. If you are only listed in the land register, but your mother has the usufruct right (from renting), you would not be able to claim these costs. In this case, it would be advisable for your mother to bear the costs so that she can claim them.
The tax impact (percentage) depends on how high the remaining income or taxable income is. This cannot be answered in a blanket manner here because this information is missing. If an approach to roof renovation is possible within the framework of advertising costs, these costs would reduce the taxable income accordingly. It would then need to be calculated how high the income tax would be after deduction. The difference to the tax that would arise without the deduction would then be the savings from these expenses.
I hope this answers your question, otherwise feel free to ask for further clarification free of charge.
I would like to point out that this forum cannot replace a detailed and personal tax consultation, but is primarily intended to provide an initial tax assessment. By adding or omitting relevant information, the legal assessment of your matter could be different.
