renovation by the landlord

Our landlord has been working on renovating our bathroom for six months already. Only a new shower, some tiles, and cables have been done so far. We have a never-ending construction site. How long do we have to tolerate this situation?

Dear inquirer,

a duty to tolerate arises for you fundamentally from § 554 BGB. However, the duty to tolerate does not prevent you from reducing the rent for the period of restricted usability of your apartment. If you want to reduce it, you must notify the landlord in advance and present the reasons for the reduction (the defects). From this point on, you are entitled to reduce it.

The landlord is obliged to promptly complete the measures to be carried out and therefore may not delay the completion culpably. If he does so, you have the right to terminate the contract without notice.
