Gastronomy parking spaces
Hello! For the extension of a restaurant in 1995 with 100 square meters of indoor dining area and 60 square meters of terrace, the architect calculated 16 parking spaces, which he marked in front and behind the restaurant.
I have rented out the area behind the restaurant without knowledge of this drawing. I have given the restaurant a lease contract for 10 parking spaces in front of the restaurant. Now the tenant's lawyer is claiming that her client is entitled to 16 parking spaces based on a building permit that she somehow obtained. Can she do that? Do the 60 square meters of terrace even count as "guest area" according to the Bavarian parking regulations?
There is a municipal development plan from 1996 for the area as a special zone, with parking spaces marked on it. However, the area in question is now a horse paddock. Am I obligated to use the horse paddock as parking spaces, even though I have enough parking spaces on a neighboring plot of land? Einsatz 40 Euro.
