Creditreform and Schufa
May 28, 2010 | 30,00 EUR | answered by Dr. Dr. Danjel-Philippe Newerla
Hello!
The following problem is bothering me!
Yesterday, I viewed a new apartment and also got it. I signed a preliminary contract and provided all my personal data. I also had to consent to the German Annington obtaining information about my creditworthiness from Creditreform/Schufa. The landlord said that the correct lease agreement will be sent to me for signature in about 5 working days. All good!
Now, I am afraid because I don't know if anything negative could be found about me in the credit check. I have never had any debts or been involved with the court, I have never had cell phone contracts, and my bank account has always had a positive balance. I have had a few debt collection processes due to online orders, but I always paid them in the end. Could this now be a problem for me and could the landlord deny me the apartment based on such entries? What information will he receive about me?
I would be very grateful for a quick response.
Best regards.
Dear Inquirer,
Thank you once again for your inquiry! Below, I would like to address your questions as follows:
First of all, I would like to briefly explain that it is indeed common for a landlord to request a Schufa credit report.
This allows the tenant to find out if there are any existing entries against them. These could be current entries for debts that have not yet been settled, or deleted entries for debts that have already been settled.
Based on your description of the situation, you have already dealt with debt collection agencies. This suggests that you were in payment arrears with certain debts. The arrears would have given the respective creditors the right to report to the Schufa.
However, you would normally have been informed of such a report, so based on your description, I assume that there are no such entries against you and you do not need to worry.
Not every debt collection agency reports matters to the Schufa immediately. This is mainly because not everyone can make entries with the Schufa, only members can. Membership is also subject to fees.
I would like to point out the following to you:
The legal advice I have provided is based solely on the information you have provided. My response is only an initial legal assessment of the situation and cannot replace a comprehensive evaluation of the facts. Adding or omitting relevant information can lead to a completely different legal assessment.
I hope that my explanations have been helpful. Please feel free to ask if you have any further questions.
I hope I have answered your question to your satisfaction and wish you a pleasant Friday afternoon and a relaxing weekend!
Best regards from the North Sea coast
