Forced switch from private health insurance to statutory health insurance?
Dear Sir or Madam,
In 2009, I was self-employed for a few months, before that I was abroad. Since 01.01.2010 I have been employed again, so I am in an employment relationship. I am above the income threshold for compulsory health insurance and my employer says I now have to go back to statutory health insurance, and I can only switch back to private health insurance in three years, even though I have been privately insured since 2004. Is that correct?
As I understand the grandfathering rule, I should be allowed to stay in private health insurance, since I was employed and above the income threshold in February 2007. I have also been above the income threshold for three consecutive years since 2004. Is there a way to apply for a general exemption?
A detailed list of the periods is as follows:
01.01.2004 - 31.12.2004
Employed and above the income threshold, insured in a private health insurance
01.01.2005 - 31.12.2005
Employed and above the income threshold, insured in a private health insurance
01.01.2006 - 31.12.2006
Employed and above the income threshold, insured in a private health insurance
01.01.2007 - 30.06.2007
Employed and above the income threshold, insured in a private health insurance
01.07.2007 - 31.07.2009
Abroad, insured through a private international health insurance
01.08.2009 - 31.12.2009
Self-employed and insured in a private health insurance
From 01.01.2010
Employed and above the income threshold
I would be very grateful for clarification.
Best regards
