Asset calculation when receiving basic security
October 25, 2010 | 50,00 EUR | answered by Steffan Schwerin
I have been appointed by the district court as the legal guardian for a 22-year-old disabled woman for all matters. The young woman under guardianship has a severe disability card (100%), works in a workshop for disabled people, and also lives in a residential home there. She receives basic security benefits and a monthly workshop salary of approximately 125 euros.
In 1999, I invested the money from the sale of the house of the deceased parents in a secure insurance deposit for the protected person. In December 2011, there will be a one-time payment of 18,359.00 euros or the option of a lifelong monthly pension of 75.70 euros.
What should I keep in mind to ensure that my ward receives as much of the inherited money as possible?
Dear Questioner,
I will answer the questions you have posed taking into consideration the circumstances described and your input as follows:
Firstly, a decision must be made whether to take a one-time payment or monthly payments.
If possible, the life expectancy of the beneficiary should be determined by a medical professional. As morbid as it sounds, this can help calculate whether monthly payments or a one-time payment would be more beneficial.
If the woman is expected to live at least another 20 years, then monthly payments would be worthwhile.
Furthermore, it would be wise to inquire if your beneficiary has any major wishes that could be fulfilled with a one-time payment.
Otherwise, it is important to ensure that the money is invested wisely and securely.
I must also point out that this platform cannot replace a comprehensive and personal legal consultation. It is solely intended to provide an initial rough assessment of your legal issue based on the information you have provided to a lawyer. The legal advice I give is based solely on the facts you have provided. Adding or omitting relevant information in your description of the situation could lead to a completely different legal assessment.
I hope I have been able to give you an initial overview and that my explanations have been helpful. You are welcome to contact me through the follow-up option on this platform.
Furthermore, I am available for legal representation. The initial consultation fee would be fully credited towards your total fee.
Distance between lawyer and client is not an issue. With the use of modern communication tools such as email, mail, fax, and telephone, legal representation is still possible.
Sincerely,
Steffan Schwerin
