Domain Name as Company Name
December 18, 2009 | 50,00 EUR | answered by Steffan Schwerin
Domain flying-trader.de and .com have been registered by me, no further registrations of this name. Domain for a website of a trade with accessories and other goods. Registration for the protection of this name necessary, if the name is also in the business registration and at the same time registration with the Chamber of Commerce? Domain theflyingtraders.com already exists - risk of confusion? - Possible legal problems therefore inevitable? Best regards, Arne Beck
Dear questioner,
I will answer the questions you asked, taking into account the situation described and your commitment as follows:
If the domain names are intended to become the company name and also represent the goods offered, it is advisable to register as a word mark with the DPMA.
While not mandatory, this can protect against issues, especially if the other user of the domain theflyingtraders.com asserts rights. There may indeed be a risk of confusion. However, this depends on what the other user offers and what the domain represents.
Therefore, I can only recommend conclusively to protect the name Flying-Trader as a trademark.
You can find further information on this at www.dpma.de.
