Mr. X sells a rubber button for a specific purpose over the internet and is warned by Mr. Y, who has registered a design pattern for a rubber button in a similar design. Mr. Y describes the same intended use in his design pattern application. Mr. Y's design pattern application dates back to the year 2010.
Since January 2011, Mr. X has been sourcing the button from a supplier who has been offering the item for sale since around the year 2000 (albeit for a different purpose). Mr. X slightly modifies the button to make it ready for sale for his purposes.
Is a warning justified?

Yes, a warning letter would be appropriate in this case.
However, it is not X who can issue the warning to Y, but the supplier must do so.
The supplier is the rights holder and can therefore only enforce his rights against Y for cessation.
But X can inform the supplier of Y's violation and thus facilitate the warning letter.
