Apartment renovation
December 26, 2009 | 20,00 EUR | answered by Steffan Schwerin
Hello,
I have moved out of my rental apartment and have hired a company to carry out renovations.
Price: 440 euros
The work that the company has done is indescribable.
Furthermore, the company has not yet sent me an invoice. Only a confirmation of the order.
Nevertheless, the company has now engaged a debt collection agency. The company and the debt collection agency have only contacted me by email, not by post.
My question:
Is the demand justified? Is an order confirmation sufficient?
Best regards
Sven Kirschner
Dear questioner,
I will answer the questions you have asked, taking into account the circumstances described and your contribution as follows:
As long as there is no invoice, you do not need to pay.
Furthermore, this is a contract for work. This means that as long as you have not accepted the work - in this case, the repair - you also do not have to pay.
Only once the repair has been carried out without defects can the company demand payment from you.
Until then, you can argue that the work was defective.
I would like to point out that this platform cannot replace a detailed and personal legal consultation. The sole aim is to provide an initial approximate assessment of your legal issue based on the information you have provided to a lawyer. The legal advice I give is based solely on the information you have provided. Adding or omitting relevant information in your description of the situation can lead to a completely different legal assessment.
I hope I have been able to give you an initial overview and that my explanations have been helpful. Please feel free to contact me through the follow-up option on this platform.
Furthermore, I am also available to represent you as part of a mandate. I would credit the initial consultation fee to you in full.
A greater distance between lawyer and client is generally not a problem. With the help of modern communication tools such as email, mail, fax, and telephone, carrying out a mandate is also possible.
Sincerely,
Steffan Schwerin
