Taking photographs of private individuals
August 24, 2011 | 35,00 EUR | answered by Steffan Schwerin
Is it allowed under current law to discreetly photograph the legs of a person at an S-Bahn station without obtaining their consent? The photos will not be published, not made accessible to third parties, and the legs being photographed have a general appearance without obvious identifying features. If others happen to witness the photography, can they demand the deletion of the image? Unfortunately, there are very contradictory opinions circulating on the internet regarding this issue.
Dear Questioner,
I will answer the questions you have raised taking into account the circumstances described and your input as follows:
If you are taking these recordings for private purposes, only the "owner" of the legs can prohibit you from doing so.
The person affected may also file a complaint against you under certain circumstances.
If you are secretly taking these recordings and using them only for private purposes, while this may be morally questionable and possibly reprehensible, it is not legally actionable.
If someone observes the photography, that person cannot demand deletion.
I must point out that this platform cannot replace a comprehensive and personal legal consultation. The sole aim is to provide an initial rough assessment of your legal problem based on the information you have provided to an attorney. The legal advice I provide is based solely on the information you have provided. By adding or omitting relevant information in your description of the circumstances, a completely different legal assessment may result.
I hope I have been able to give you an initial overview and that my explanations have been helpful. You are welcome to contact me through the follow-up option on this platform.
Furthermore, I am of course available for mandate. The initial consultation fee already paid would be fully credited.
A greater distance between lawyer and client is generally not a problem. With the help of modern communication means such as email, post, fax, and telephone, handling a mandate is also possible.
Best regards,
