I have a business that the trade office tells me I should deregister because I have a guardian. My guardian can only cancel contracts. My question is, a business registration is not a contract, so does the guardian have no right over my self-employment, correct? The trade office tells me I have to deregister the business because my driving license is not good. The trade office says if I don't deregister, they will file a complaint against me. Should I deregister the business or continue as self-employed? Please help me, I need a lawyer that I can pay in installments, and I want to cancel my guardian because she has ruined my nerves. Unfortunately, I cannot cancel the guardian through a lawyer. I want a lawyer to act as my guardian.
Dear questioner,
I will answer the questions you have asked, taking into account the circumstances described and your contribution, as follows:
A payment plan is not an option in this case. The €20 you have contributed should be paid to the portal operator. Further compensation will then be arranged between the portal operator and the signatory.
If the trade office believes that you are no longer capable of conducting business and therefore should deregister your business, you should attend to this promptly. Otherwise, there is a risk of an administrative offense and a significant fine.
If you do not agree with your legal guardian, you should contact the court and request the appointment of a new guardian.
If you wish to have a lawyer as your guardian, you should choose a colleague in your area who also acts as a guardian and then suggest them.
Subsequently, it should be clarified with the guardian to what extent the business activity can be maintained or not.
I must point out that this platform cannot replace detailed and personal legal advice. The aim here is solely to provide an initial rough assessment of your legal problem based on the information you have provided to a lawyer. The legal advice I provide is based solely on the information you have provided. By adding or omitting relevant information in your description of the situation, a completely different legal assessment may result.
I hope I have provided you with an initial overview and that my explanations have been helpful. You are welcome to contact me through the follow-up option on this platform.
Furthermore, I am available for legal representation. The initial consultation fee paid would be credited in full.
A greater distance between lawyer and client is generally not a problem. With the help of modern communication tools such as email, mail, fax, and telephone, legal representation is also possible.
Best regards
