Separation

Hello, I have an urgent question. My partner and I bought a house three weeks ago, which is still in the process of being finalized. Now he wants to separate, but the problem is that I financed the loan alone using my own capital and my building society savings contract. He is also listed in the notary contract. What can I do? Do I have to buy him out or does he have any claims?
Dear Seeker,
Thank you for your inquiry.
Unfortunately, I am not quite clear on what you specifically mean by "in der Abwicklung."
If I understand you correctly, you have entered into a valid purchase agreement for the house.
It would need to be examined whether you may still be able to withdraw from the purchase agreement. This cannot be answered without a thorough review of the contract.
I would be happy to review the contract regarding a right of withdrawal as part of a separate engagement. If interested, you can send me the contract (initially completely free and non-binding) by email (info@drnewerla.de).
You do not have to pay him out (yet). I currently see no reason for this.
As mentioned earlier, it is crucial to have a professional examination done to determine if and under what conditions you can still withdraw from the land purchase contract.
I hope this helps.
Best regards,
Dr. Danjel-Philippe Newerla, Attorney
