Right of residence and residence permit

I am a foreigner with Jordanian citizenship. I studied and completed my studies in Jordan for 2 years, but came to Germany on 21.12.1996 with a study visa to start a new degree. On 09.09.99, I married a German woman, which granted me a two-year residence permit for family reunification and an unlimited work permit. Officially, we were married for 1 year and 8 months, as we separated in May 2001 and divorced in March 2003. After the separation in 2001, the immigration office revoked my residence permit, but then granted me a residence permit for studies. I retained the unlimited work permit, and continued with my studies at FH Düsseldorf, although I have not completed them. I am still enrolled but have put my studies on hold due to work commitments.

Due to my unlimited work permit, I found a full-time position at the Kuwait Military Medical Office in Aachen on 01.01.2010, where I work in reception and general office tasks due to my fluency in both German and Arabic, as well as my familiarity with Arab mentality. This medical office treats Kuwaiti patients from the Ministry of the Interior and Ministry of Defense in Germany, and is affiliated with the Kuwaiti Military Office in Paris, registered at the Kuwaiti Embassy in Paris. This is why the office is registered with the Kuwaiti Embassy in Germany and not with the German Foreign Office.

After applying for a residence permit at the immigration office, it was initially rejected, but I was granted a work permit until July with a temporary stay certificate. Subsequently, they refused to extend it and issued me a deportation order. My lawyer filed a lawsuit against the immigration office and submitted a petition, which did not yield much result. He then applied to the Hardship Commission on my behalf, and we are currently awaiting a decision. I currently have a tolerated stay permit for 3 months, and still possess the unlimited work permit, continuing to work full-time at the office since 01.01.2010.

I have submitted three employment certificates to the immigration office, and my Kuwaiti bosses, who have diplomatic credentials issued in Paris, are willing to support me in court. They alternate weekly between Paris and Germany with their families.

I am well integrated, fluent in written and spoken German, and have been living in Germany for 14-15 years without any criminal record in Jordan or Germany, and have never claimed social benefits.

My question is: do I have any hope of obtaining a residence permit, and what are the prospects in my case? Are there any aspects that could support my case? Will the Hardship Commission decision affect me? If I were to marry a Bulgarian woman from Bulgaria who does not reside in Germany but wishes to move here, would that change my situation if we were to marry, considering she is from the new EU member states?

I kindly request detailed advice.

Yours sincerely
