Fee exemption for childcare

Can already paid kindergarten fees (to the EV church community) from September 2008 to September 2009 be reclaimed if the parents of the child who is now of compulsory school age were below the minimum income threshold (both unemployed). The family was unaware that they supposedly did not have to pay fees for the third and final year of kindergarten.

Is there still a claim now? - if yes, where can this claim be made? The family is missing the money everywhere.

Thank you very much!

Dear questioner,

I will answer the questions you have posed taking into account the circumstances described and your efforts as follows:

Here, the contributions can also be reclaimed. For this purpose, a corresponding request must be made to the kindergarten provider.

If the contributions are paid to the church, they must also be reclaimed there.

To do this, write a letter and request the contribution back. Relevant evidence must be provided to show that you were below the minimum income threshold.

Finally, I would like to point out that this platform cannot replace a detailed and personal legal consultation. The sole purpose is to provide an initial rough assessment of your legal issue based on the information you have provided by a lawyer. The legal advice I provide is based solely on the information you have provided. By adding or omitting relevant information in your description of the circumstances, a completely different legal assessment may result.

I hope I was able to give you an initial overview and that my explanations help you. Feel free to contact me through the follow-up option on this portal.

Furthermore, I am of course available for legal representation. The initial consultation fee already paid would be fully credited.

A greater distance between lawyer and client is generally not a problem. With the help of modern means of communication such as email, mail, fax, and telephone, legal representation is also possible.

Yours sincerely,
