termination of the electricity contract
September 26, 2009 | 20,00 EUR | answered by Michael Vogt
My electricity supplier has increased the annual rate by more than 100 euros. The increase was only communicated to me by Flexstrom in August. As a result, I terminated the contract with immediate effect, but the supplier is refusing to release me from the contract until August 2010. Is this legal? I have even received a letter from a debt collection agency.
Dear inquirer,
I am happy to answer your question based on the circumstances you have described and taking into account your contribution as follows:
In the event of an increase in the electricity price, i.e. a change in the contract terms to your disadvantage, you have the right to terminate the electricity supply contract without notice.
It is important that the termination is made in writing and that you can prove in case of dispute that the termination has been received by your contracting partner.
Therefore, you should send the termination letter in copy to the debt collection agency again.
If you continue to be harassed afterwards, you should consider hiring a lawyer.
I hope that my answer has given you an initial overview of the legal situation.
I would like to point out that this answer, based on your information, is only a first legal assessment of the situation. It cannot replace a comprehensive evaluation. By adding or omitting relevant information, the legal assessment may differ completely.
