Resolution of the savings account

I forgot to dissolve an accumulated savings account from 2007 in the following years. The tax office now wants to apply the dissolution in the still open tax year 2010. However, I would like the dissolution to take place in 2008 instead. What options do I have to make this happen in 2008?

The right to prematurely dissolve the reserve for investment grants can be exercised at the latest until the finality of the tax assessment to which the dissolution should have an effect. Therefore, you can only dissolve the reserve for investment grants for the calendar year 2008 if your income tax assessment for the calendar year 2008 has not yet become final. Your income tax assessment for the calendar year 2008 generally becomes final at the end of the one-month objection period. A later correction of the final income tax assessment can only be made if the tax assessment was issued subject to review under § 164 of the Tax Code (AO) or provisionally under § 165 AO. If the objection period against your income tax assessment for the calendar year 2008 has expired and the income tax assessment was not issued subject to review or provisionally, unfortunately, the dissolution of the reserve for investment grants in the calendar year 2008 is no longer possible.
