New job.
April 5, 2011 | 35,00 EUR | answered by StB Olaf Gayko
Hello! Starting from 01.05.2011, I have a new job. It is approximately 95 km away from our (family) home base. Even with a car, this distance is not feasible to drive daily. I have to rent a small apartment at the location of the new workplace. Here are my questions now:
1) In Germany, there is freedom of choice in employment and profession. Does the reason for termination still play a role for the tax office regarding 2) costs for accommodation, meals, and trips home (My reason for termination is due to a very, very bad working atmosphere)?
3) Are the costs mentioned under 2) fully deductible? €24 for 3 months/year for meals?
4) Can a monthly allowance be requested from the tax office based on these costs?
5) What else have I forgotten? Thank you for your efforts.
Kind regards, Hartmut Eckert. You can reach me on my mobile at 0172-52 763 65.
Dear Mr. Eckert,
First of all, thank you for your inquiry, which I would be happy to answer based on the information you provided and considering your situation in the context of an initial consultation.
The response is based on the description of the facts. Missing or incorrect information about the actual circumstances can affect the legal outcome.
1) No, the reason for termination does not matter at all! What is important is solely the occupational reason for the double household management due to the (newly entered) employment relationship.
2) You can deduct all the positions you mentioned, the daily allowance for meals (in the form of a flat rate of max. €24/day for absence of 24 hours) can be claimed for a maximum of 3 months, but not annually, only once at the beginning.
3) See answer to 2)
4) Yes, you can easily apply for a tax-free allowance at the tax office, so that it can be entered on your tax card.
5) No, you haven't forgotten anything! ;)
I hope this information has been helpful to you.
Best regards,
