FIRST, SOME IMPORTANT INFORMATION ABOUT ME:
I am 22 years old, married, childless and I am obtaining my high school diploma through a second educational path. Every month, I receive 572 euros of independent Bafög funding (completely as a grant). Additionally, I work part-time and earn income up to a maximum of 300 euros per month.
My husband is a student and works as a working student/student assistant. He earns between 300 and a maximum of 550 euros per month.

Am I entitled to child benefit? Can my parents apply for child benefit retroactively from January 2012? (A new child benefit law came out in early 2012)

I would like to answer your question within the framework of an initial consultation and based on your fee commitment, in accordance with the rules of the online portal. My response relates to the situation you have presented.
It is questionable whether you are still in need of support and at what stage of education you are in.
Since you are married, it is generally assumed that your spouse is responsible for your support if you are unable to support yourself. Your parents are no longer responsible for your support and therefore cannot apply for child benefits.
There is an exception if you and your spouse together are unable to support yourselves. Your parents must explain this when applying for child benefits. This means you must disclose your income and your husband's income, and the family benefits office will determine if you can support yourselves together.
Applying for child benefits also requires that you are in vocational training. This generally includes attending general education schools (e.g. high school), but always on the condition that you do not already have a completed vocational training.
It is also important to note that you cannot engage in harmful employment. This means you can work a maximum of 20 hours per week.
Under these conditions, you can apply for child benefits.
