Ask a lawyer on the topic of Traffic law

Received a fine notice - what to do?

Dear lawyer,

my name is Edith Lehmann and I recently received a fine notice that has left me very unsettled. I was allegedly caught speeding and am now being asked to pay a fine, even though I am not aware of any wrongdoing.

The situation was as follows: I was on my way to work and driving on the highway. Suddenly, a speed camera flashed and a few days later I received the fine notice. I am certain that I was not driving above the speed limit, as I always adhere to speed restrictions. Furthermore, I did not overlook any traffic signs or violate any other traffic rules.

Nevertheless, I am concerned as I do not know how to proceed. Should I simply pay the fine or are there ways to contest it? I do not want to just accept being unfairly punished.

Could you please assist me and explain what steps I should take next? Is it possible to lodge a complaint against the notice, and how should I go about it? I would like to defend my rights and ensure that I am treated fairly.

Thank you in advance for your help.

Sincerely,
Edith Lehmann

Dear Mrs. Lehmann,

I understand your concern and can empathize with how you feel unfairly treated. It is important that you defend yourself against the fine if you are not aware of any fault. First of all, I want to assure you that there are indeed ways to challenge the fine and lodge an objection.

If you believe that the fine was unjustly issued, you should definitely lodge an objection. This is your right and allows you to examine the case more closely. To lodge an objection, you must submit a written objection to the competent district court within a certain deadline. In your objection, you should clearly explain why you consider the fine unjustified and present all relevant facts and evidence.

It is advisable to seek support from an experienced traffic law attorney. An attorney can help you professionally formulate your objection and coordinate all legal steps. Furthermore, an attorney has the necessary expertise to represent your interests to the best of their ability.

In your case, I would first recommend gathering all relevant documents and information that could prove your innocence. This could include witness statements, photos, or other documents. Then, you should promptly contact an attorney to discuss the next steps together.

Please note that it is important to comply with the deadline for lodging an objection against the fine, as otherwise the decision will become final and the fine will be due. Therefore, do not hesitate and contact an attorney immediately to protect your rights and ensure fair treatment.

I hope this information is helpful to you and I am available for further questions.

Sincerely,
Jessica Lange
