Ask a lawyer on the topic of Traffic law

How can I lodge an objection against a fine notice?

Dear lawyer,

I am in urgent need of your help. A few weeks ago, I received a fine notification that has left me very unsettled. The situation was as follows: I was caught speeding at 45 km/h in a 30 km/h zone. At that time, however, I was convinced that I was not driving that fast and I am certain that there has been a mistake.

The fine notification has now arrived and I am supposed to pay a fine of 100 euros and receive a point on my driving record in Flensburg. However, I am firmly convinced of my innocence and therefore wish to appeal against the notification. I am very worried about my driver's license and I do not want my point tally to be affected.

Could you please explain to me how I can best appeal against the fine notification? Are there specific deadlines that I must adhere to? What documents should I have ready for the appeal? Are there any ways to prove my innocence?

I thank you in advance for your help and support.

Kind regards,
Selma Sauer

Dear Mrs. Sauer,

Thank you for your inquiry and for the trust you have placed in me. It is understandable that you are concerned about the fine you have received. I would like to explain to you now how best to challenge the fine.

First of all, it is important that you act quickly, as an objection to the fine can only be made within a certain period of time. Usually, this period is 2 weeks from the date of delivery of the fine. Therefore, it is important that you submit your objection in a timely manner to preserve your rights.

For the objection, you should write a written statement in which you specifically explain why you dispute the speeding violation. It may be helpful to also provide witnesses or evidence that support your version of events. Additionally, you should have all relevant documents, such as the fine, measurement protocols, or photos, ready for the objection.

There are various ways to prove your innocence. One possibility would be to question the procedure of the measurement or the accuracy of the measuring device. It may also be advisable to request access to the files in order to obtain all relevant information about the case and to substantiate your objection.

It is important to emphasize that objecting to the fine is not a guarantee that the penalty will be overturned. However, it may lead to the case being reviewed again and give you the opportunity to present your perspective.

I hope this information is helpful to you and I am available to support you in your objection. Please do not hesitate to contact me if you have any further questions.
