Ex-boyfriend demands money.
December 21, 2010 | 30,00 EUR | answered by Steffan Schwerin
Hello,
so my ex-boyfriend transferred 1000 euros to me a year ago so that I could break free from a bad relationship.
We didn't agree on anything in writing. So I didn't sign anything and he just transferred the money to me.
Now he wants it back and says that with liquidation and purpose of use it was not a gift of money and he would definitely be able to claim it back. Also, I have debts and the collectors wanted to seize my account. I was able to come to an agreement with them and they said that if anything comes up and they notice it, the agreement is terminated and they will seize me. My question is, does my ex-boyfriend have the right and should I try to come to an agreement with him, which he is hardly willing to do, or will I have the right? I don't have the money at the moment and I hope he doesn't get away with it.
Dear questioner,
I will answer the questions you have raised, taking into account the circumstances described and your commitment as follows:
Whether your ex-partner has a claim to the money depends on what you agreed upon.
If he gifted you the money, he cannot simply demand it back.
If he only loaned you the money, then he can request it back.
You need to agree on the repayment terms.
You should offer him a payment plan.
If you have evidence that it was a gift, then you are not obligated to repay him.
Finally, I would like to point out that this platform cannot replace a detailed and personal legal consultation. The goal here is solely to provide an initial rough assessment of your legal issue based on the information you have provided to an attorney. The legal advice I provide is based solely on the facts you have provided. Adding or omitting relevant information in your description of the situation may lead to a completely different legal assessment.
I hope I have been able to give you an initial overview and that my explanations help you. Please feel free to contact me through the follow-up option on this platform.
Furthermore, I am also available for legal representation. The initial consultation fee would be fully credited towards your case.
A greater distance between lawyer and client is generally not a problem. With the help of modern communication tools such as email, mail, fax, and phone, legal representation is still possible.
Best regards,
