Ask a lawyer on the topic of Neighbor law

Can my neighbor park his party guests on my property?

Dear lawyer,

I am contacting you because I have a problem with my neighbor. For some time now, my neighbor has been regularly hosting parties in his house, to which many guests are invited. Since his property does not offer enough parking spaces, his party guests often park their cars on my property, as it is closer to his house.

This is causing a burden for me, as my property is constantly blocked by parked cars and I have barely any space left to park my own car or use my garage. Furthermore, the parking of the party guests is affecting my privacy, as I constantly have strangers' cars in front of my house.

I am concerned that this situation could worsen and I am wondering if my neighbor even has the right to park his guests' cars on my property. Are there any legal options to prohibit my neighbor from parking on my property? What steps can I take to find a solution to this problem?

I thank you in advance for your help and look forward to hearing from you.

Sincerely,
Gerd Schneider

Dear Mr. Schneider,

Thank you for your inquiry regarding the issue with your neighbor and the party guests who park their cars on your property. It is understandable that you feel burdened by this situation and are seeking legal options to address it.

In principle, every owner of a property has the right to determine and decide who can park on their property. This means that your neighbor does not have the right to park the cars of his guests on your property without your permission. Unauthorized parking on your property constitutes a disturbance of possession and can be legally punished.

To prohibit your neighbor from parking on your property, you can take various steps. First, you should have a conversation with your neighbor and politely but firmly point out that parking on your property is not allowed and that you prohibit it. If your neighbor is not cooperative, you can write a formal warning letter and give him a reasonable deadline to stop unauthorized parking.

If your neighbor continues to violate your rights, you can take legal action. You can hire a lawyer to file an injunction against your neighbor. In such a proceeding, the court can order your neighbor to refrain from parking on your property and impose a fine in case of violation.

It is important that you document all interactions and communication with your neighbor in writing to be able to provide evidence in case of a legal dispute. Furthermore, it is advisable to seek legal advice early on to find the best possible solution to your problem.

I hope this information is helpful to you and wish you success in resolving your neighborhood dispute. If you have any further questions, please feel free to contact me.

Sincerely,
