Waiver of compulsory share/inheritance claim.

Does a biological daughter have a compulsory portion claim if the father's 100% share in a GmbH is inherited by someone else? Can a creditor legally enforce the compulsory portion claim or inheritance supplement claim of a debtor if the debtor has waived this claim, even though they are in a private insolvency proceeding?
Dear questioner,
I will answer the questions you have raised taking into account the facts presented and your input as follows:
1) Does a biological daughter have a compulsory share claim if the 100% share of the father in a GmbH is inherited by someone else?
Yes, there is always a compulsory share claim by the statutory heirs when they are excluded from the succession by the deceased's will or inheritance contract.
In this case as well, if the GmbH is inherited by a third party through a will or inheritance contract, the daughter can claim her compulsory share from them.
2) Can a creditor sue for the compulsory share or inheritance supplementation claim of a debtor in court if the debtor has waived this claim, even though they are in a personal insolvency procedure?
If the compulsory share claim is not enforced, then no creditor has access to it.
Finally, I would like to point out that this platform cannot replace comprehensive and personal legal advice. The sole aim is to provide an initial rough assessment of your legal issue based on the information you have provided by a lawyer. The legal advice I provide is based solely on the facts you have provided. Adding or omitting relevant information in your description of the situation can lead to a completely different legal assessment.
I hope I have given you an initial overview and that my explanations have been helpful. Please feel free to contact me through the follow-up option on this platform.
Furthermore, I am available for representation as well. The initial consultation fee paid would be fully credited towards this.
A greater distance between lawyer and client generally poses no problem. With the help of modern communication tools such as email, post, fax, and telephone, representation is also possible.
