2 Different Termination Confirmations
July 20, 2011 | 25,00 EUR | answered by Dr. Dr. Danjel-Philippe Newerla
Hello,
I have terminated my cable connection, phone, and internet with Kabel Deutschland.
Last week I received a confirmation of termination stating that the cable connection will end on 30.09.2011 and the phone/internet on 30.01.2012.
Today I received another confirmation with the same text but different dates. According to this letter, everything will end on 01.07.2012.
Unfortunately, I no longer have the contract and I wanted to know if I can rely on the first confirmation and if a confirmation of termination is legally binding.
What would you recommend?
Best regards,
Dear seeker of advice,
Thank you for your inquiry once again. I would like to answer it as follows:
Yes, the confirmation of termination is legally valid, as the other party acknowledges by this that the contract relationship will be terminated at a certain point in time through the termination.
Therefore, you can refer to the initial termination confirmation.
If the other party does not accept or ignores this and continues to make further demands beyond the termination date, you should instruct a colleague specializing in contract law locally to defend against the demands.
I hope I have provided you with an initial legal orientation and wish you much success and all the best!
I would like to finally point out the following:
The legal information I provided is based solely on the facts you provided. My response is only an initial legal assessment of the situation and cannot replace a comprehensive evaluation of the facts. Adding or omitting relevant information could lead to a completely different legal assessment.
I hope my explanations have helped you. You are welcome to contact me through the follow-up option.
I wish you a pleasant Wednesday afternoon.
Kind regards from the North Sea coast,
