In June 2007, we purchased a condominium (holiday home). The completion date was June 1, 2008. We have a notice of conveyance and will not agree to its deletion. Due to non-performance of contractual services, we have exercised our right to withhold payment. We have reduced partial invoices. The apartment has not yet been accepted by us and has not been handed over to us. The developer has sold the apartment a second time (with a notarial contract). The new buyer is using the apartment as a holiday home.
My question is, is a second sale of a condominium too casual and how can I defend myself against this.
