Good faith purchase of a stolen vehicle
Dear Sir or Madam,
Unfortunately, I purchased a car in good faith in 2009 that was stolen. I paid 11,300 euros for it. I received the original registration certificates Part 1 and 2 (1500 blank certificates were stolen from a district office in Hammeln in 2009), as well as 2 original remote keys. I checked the ID card of the seller and compared all the data with the vehicle. Furthermore, the vehicle identification number matched the information in Part 1 and Part 2. I could not do more to verify the vehicle. The car was registered as a scrapped vehicle of a completely different make and model.
I transported the car to my residence and when I tried to register it, it was discovered that the car was reported stolen and was immediately seized by the police. The perpetrators have not been caught to this day. I have already filed a report against unknown persons and my statement was forwarded to the prosecutor's office. Allianz Insurance settled the previous claim and is now the rightful owner of the vehicle.
Three weeks ago, the prosecutor's office decided in favor of Allianz Insurance in terms of criminal law. At this point, I feel that I am being treated unfairly.
I will try to reach an out-of-court settlement with Allianz Insurance to purchase the vehicle. If they demand an excessively high purchase price, here is my question to you: What are the chances for me to proceed legally in civil court and what are the chances of being awarded the vehicle?
