Assessment in income tax

I have founded an institute with another shareholder, which falls under the small business regulation. The turnover per year is limited to 1000 - 2000 euros.

Currently, I am preparing the VAT declaration and have the following questions:
1. Do I have to also specify the other shareholder in the VAT declaration? The tax program does not provide for this.
2. Do I have to attach this VAT declaration to my personal income tax return?
3. There is a payment received in December 2009 for the GbR. The invoices for the services provided to the GbR are from the year 2010. Should I now report half of the turnover minus the incurred costs only from the year 2009 in my income tax return?

Thank you for your inquiry, which I would like to answer based on the information provided and in the context of your involvement for an initial consultation.

1. In the sales tax return, the total turnover of the GbR must be stated, as the GbR is the entrepreneur. The number of shareholders involved in the GbR does not matter. Information about the shareholders is provided in the separate and uniform determination declaration.

2. The sales tax return is to be submitted together with the annual financial statements for the GbR, not with your personal income tax return.

3. The profit determination is prepared for the GbR. In the income tax return, only the share of profit attributable to you is stated. How the profit is determined depends on the chosen method of profit determination.

If a balance sheet with profit and loss statement is prepared for the GbR, expenses are to be recorded in the year to which they economically belong, in this case 2009.

In a (simple) income-expenditure calculation, expenses are only recorded when there is a cash flow, so in 2010.

I assume that for this scale, a (simple) income-expenditure calculation will be prepared. In this case, the expenses would only be recorded in 2010.
